Terms and Conditions
1. Scope of Work
This quotation covers the supply, delivery, installation, and commissioning of the equipment as specified herein and in the accompanying proposal.
2. Payment Terms
Payment shall follow the schedule indicated in this quotation.
Work shall commence only upon receipt of the required downpayment.
The remaining payments must be settled according to the agreed payment schedule. BearLift reserves the right to suspend delivery, installation, or commissioning until the required payment has been received.
3. Equipment Ownership
All equipment supplied under this quotation shall remain the property of BearLift / JR PeƱaflor Group of Companies Inc. until full payment has been received.
4. Delivery and Installation Condition
Delivery and installation of the equipment are subject to the Client fulfilling the agreed payment milestones and ensuring that the installation site is ready.
If the site is not ready upon equipment delivery, BearLift reserves the right to reschedule installation and charge reasonable storage or handling costs if necessary.
5. Variation of Work
Any additional work requested by the Client that is outside the agreed scope shall be treated as a Variation Order and may result in additional cost and schedule adjustments. Such variations must be approved in writing before execution.
6. Project Schedule
Project timelines are estimates and may be adjusted depending on site readiness, equipment availability, logistics, and coordination with the Client.
7. Warranty
The supplied equipment is covered by a twelve (12) month warranty against manufacturing defects under normal operating conditions from the date of installation and commissioning.
If civil works are performed by BearLift, the equipment foundation constructed by BearLift will also be covered for workmanship defects.
8. Limitation of Liability
BearLift shall not be liable for damages arising from misuse, overloading, improper operation, electrical supply issues originating from the building, or structural conditions unrelated to the equipment foundation constructed by BearLift.
9. Force Majeure
Neither party shall be liable for delays caused by events beyond reasonable control including natural disasters, shipping delays, government regulations, or other unforeseen circumstances.
